Introduction

BNS Section 81 protects women from deception relating to marriage. The provision applies when a man fraudulently causes a woman to believe that she is legally married to him and, because of that false belief, she cohabits or has sexual intercourse with him.

The law recognizes that consent obtained through deception regarding marital status is not genuine consent. Therefore, a man who deliberately creates a false impression of a lawful marriage can face serious criminal consequences.

BNS Section 81 corresponds to old IPC Section 493 and continues to safeguard women against exploitation through fraudulent or sham marriages under the Bharatiya Nyaya Sanhita, 2023.

What is BNS Section 81?

BNS Section 81 makes it an offence for a man to deceitfully induce a woman to believe that she is lawfully married to him and then cohabit or engage in sexual intercourse with her based on that belief.

The essence of the offence is deception regarding the existence of a valid marriage. The prosecution must prove that the woman genuinely believed she was legally married because of the man's deceitful conduct.

Bare Act Text of BNS Section 81

Every man who by deceit causes any woman who is not lawfully married to him to believe that she is lawfully married to him and to cohabit or have sexual intercourse with him in that belief, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.

Essential Ingredients of BNS Section 81

To establish an offence under BNS Section 81, the prosecution must prove:

  1. The accused is a man.
  2. The woman was not lawfully married to him.
  3. The accused used deceit or fraudulent conduct.
  4. The woman was induced to believe that a lawful marriage existed.
  5. The woman cohabited with the accused or had sexual intercourse with him.
  6. Such cohabitation or intercourse occurred because of the false belief of marriage.
  7. The deception was intentional.

Punishment Under BNS Section 81

A person convicted under BNS Section 81 may be punished with:

  • Imprisonment of either description for a term extending up to 10 years; and
  • Fine.

The severity of punishment reflects the serious nature of deceiving a woman regarding her marital status for the purpose of cohabitation or sexual relations.

Old Law vs New Law (IPC → BNS Mapping)

Old IPC Section BNS Section
IPC Section 493 BNS Section 81

BNS Section 81 replaces IPC Section 493 and substantially retains the same legal principles relating to deceitful inducement of a woman into believing that a lawful marriage exists.

Important Case Laws / Judgments

Ram Chandra Bhagat v. State of Jharkhand

The Supreme Court observed that the prosecution must establish that the woman genuinely believed she was lawfully married because of the accused's deception.

Emperor v. Gopal Das

The Court emphasized that mere intimacy is insufficient; there must be intentional deceit creating a false belief of a valid marriage.

Re: Relevant Judicial Interpretation

Courts have consistently held that the offence is complete when cohabitation or sexual intercourse occurs as a result of a deceitfully created belief of lawful marriage.

Defences Available to the Accused Under BNS Section 81

Depending on the facts of the case, possible defences may include:

  1. Absence of deception.
  2. No false representation regarding marriage.
  3. The woman never believed that a lawful marriage existed.
  4. No cohabitation or sexual intercourse occurred because of such belief.
  5. False implication.
  6. Lack of evidence supporting the allegations.
  7. Contradictions in witness testimony.

Real-Life Example of BNS Section 81

A man conducts a sham marriage ceremony and falsely represents to a woman that they are legally married. Believing the marriage to be valid, the woman begins living with him as his wife and engages in marital relations.

If it is later discovered that the marriage was never legally valid and the man intentionally deceived her, he may be prosecuted under BNS Section 81.

Conclusion

BNS Section 81 protects women from being deceived into believing that a lawful marriage exists when, in reality, no valid marriage has taken place. The law criminalizes situations where such deception leads to cohabitation or sexual intercourse.

As the successor to IPC Section 493, the provision continues to provide legal remedies against fraudulent marital representations and ensures that women are protected from exploitation through deceit. Given the seriousness of the offence, it is cognizable, non-bailable, and punishable with imprisonment of up to ten years along with fine.
